Workers who contracted COVID-19 out of or in the course of work may be entitled to the usual benefits and services offered by the Act respecting industrial accidents and occupational diseases. It should be noted that only workers who contract the disease because of their work can be compensated. Indirect contamination, such as a member of the worker’s immediate family, is not compensable by CNESST.

To be eligible for a claim for COVID-19, the worker must consult a doctor to obtain the medical certificate confirming the diagnosis, notify his employer as soon as possible and complete the worker’s claim that will be sent to the Commission des normes, de l’équité, de la santé et de la sécurité du travail (CNESST). This form is available online via “Mon Espace CNESST“. The worker will have to demonstrate, on a balance of probabilities, the link with the work.

Exceptionally, CNESST may process a claim for a confirmed or probable infection with COVID-19 when the worker completes the Worker Claim Form (RTR) and declares that he or she is a carrier of COVID-19 and has received a positive test or has been placed in isolation ordered by a nurse.

COMPENSATION A WORKER MIGHT RECEIVE

If the worker’s claim is accepted, he or she may request reimbursement for the costs related to:

  • Medical assistance costs, including medication
  • Travel expenses
  • Accommodation costs

In order to do so, the worker must complete the expense claim form, which is available online. If they become unable to work, they may be eligible for income replacement benefits.

TIME OF COMPENSATION

Once the claim has been accepted, the worker may be reimbursed for all costs incurred for care, treatment or medication related to his or her employment injury, in accordance with the legal framework.
